Individuals can bring suit against foreign powers that supported terrorists.
The Supreme Court issued its opinion in the case of Opati v. Republic of Sudan this past week. The justices of the court were unanimous in their decision in favor of those seeking to bring suit against nations that supported terrorist organizations. The opinion released by the court was written by Justice Gorsuch, and rejected Sudan’s plea for the Court to “create and apply a new rule requiring Congress to provide a super-clear statement.”
Over two decades ago, al-Qaeda members bombed U.S. embassies in Kenya and Tanzania, resulting in the deaths of over 200 people. Congress passed a new measure in 2008 allowing victims of terror to seek damages from normally immune entities, such as independent nations. The lawsuit brought against Sudan by family members of victims will now be allowed to move forward as a result of the Court’s decision.
